Terms of Service

The rules for using the CITY FM website, stream and apps.

These Terms of Service ("Terms") govern your use of the CITY FM website at www.cityfm.in, the CITY FM live audio stream, and the CITY FM mobile applications for Android and iOS (together, the "Services"). The Services are operated by EBN (Entertainment & Broadcasting Network), a sole proprietorship based in Srinagar, Jammu & Kashmir, India ("EBN", "CITY FM", "we", "us" or "our").

By accessing or using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

1. Eligibility

You may use the Services only if you are able to form a legally binding contract under applicable law. If you are a minor, you may use the Services only with the involvement of a parent or guardian.

2. The Service

CITY FM is a free internet radio service that streams music, talk and related content. We may add, change, suspend or discontinue any part of the Services at any time without notice. We do not guarantee that the stream will always be available or uninterrupted.

3. Permitted use — personal and non-commercial only

The Services are provided for your personal, private and non-commercial use only. You may listen to the stream for your own enjoyment. You may not use the Services, in whole or in part, for any commercial purpose without our prior written permission.

In particular, you must not use the CITY FM stream for public performance or communication to the public (for example, playing it in a shop, restaurant, café, gym, office, event or other public or commercial premises). Such use requires separate music licences obtained by you from the relevant copyright societies, and is your responsibility.

4. Stream protection and prohibited conduct

To protect the Services and the rights of others, you agree that you will not, and will not attempt to or permit anyone else to:

  • record, capture, download, copy, store, reproduce or create derivative works from the stream or any content, except as expressly allowed by law;
  • retransmit, rebroadcast, redistribute, sub-licence, sell, rent or otherwise make the stream available to others;
  • embed, frame, hotlink or deep-link the audio stream or stream URLs into any other website, app or service without our written permission;
  • reverse engineer, decompile, scrape, or attempt to extract the underlying stream URLs, source code or data;
  • circumvent, disable or interfere with any security, access-control, geographic or technical limitation of the Services;
  • use bots, crawlers or automated means to access the Services or impose an unreasonable load on our infrastructure;
  • use the Services for any unlawful, infringing, harmful, abusive or fraudulent purpose, or in breach of any applicable law.

5. Intellectual property

The CITY FM name, the "CITY FM" logo, the EKDAM KADAK tagline, and all original text, graphics, design, audio idents and other materials we create are the property of EBN and are protected by copyright, trademark and other laws. All trademarks and rights belong to EBN. You may not use them without our prior written consent.

Music, sound recordings and other third-party works made available through the Services remain the property of their respective owners. Nothing in these Terms transfers any ownership in such works to you. Our handling of third-party rights and the procedure for rights holders is set out on our Copyright & Grievance page.

6. Third-party content and links

The Services may rely on or link to third-party services and websites (including our streaming provider, web host, app stores and social media). We do not control and are not responsible for third-party services or their content, and your use of them is governed by their own terms and policies.

7. Disclaimers

The Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Services will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected.

8. Limitation of liability

To the maximum extent permitted by law, EBN and its proprietor shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, profits, goodwill or other intangible losses, arising out of or relating to your use of (or inability to use) the Services. Our total liability for any claim relating to the Services shall not exceed one thousand Indian Rupees (₹1,000).

9. Indemnity

You agree to indemnify and hold harmless EBN and its proprietor from any claims, damages, liabilities and expenses (including reasonable legal fees) arising out of your misuse of the Services or your breach of these Terms or of any applicable law or third-party right.

10. Termination

We may suspend or terminate your access to the Services at any time, without notice, if you breach these Terms or use the Services in a way that may cause harm or legal liability. The sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability and indemnity) will continue to apply.

11. Governing law and jurisdiction

These Terms are governed by the laws of India. Subject to applicable law, the courts at Srinagar, Jammu & Kashmir, India shall have exclusive jurisdiction over any dispute arising out of or relating to the Services or these Terms.

12. Grievance redressal

For any complaint relating to the Services or to content, please contact our Grievance Officer. Details and the procedure are set out on our Copyright & Grievance page. We aim to acknowledge complaints within 24 hours and resolve them within 15 days.

13. Changes to these Terms

We may revise these Terms from time to time. The "Last updated" date above shows when they were last changed. Your continued use of the Services after changes take effect means you accept the revised Terms.
